There are four laws and a few by-laws on the subsoil, maintain requirements and standards of the Soviet period, in the Kyrgyz Republic. It is recommended to consolidate the laws and by-laws on the subsoil into a single Mining Code to eliminate contradictions and various readings in the legislation. The Mining Code is to be based on the advanced global experience in the subsoil use control, to be targeted to create favorable conditions for mineral prospecting and exploration investment and to be free from relict of planning-and-command guidance system of management incompatible with the market mechanisms of production planning. It is proposed to use international nomenclature and classification of mineral resources, and to abandon state examination and approval of mineral reserves as well as to forgo numerous expert reviews of feasibility studies and projects on sound subsoil use. Public officers should forfeit their functions as experts. It is advised to slacken administrative pressure on mines and to switch on economic regulators. The Code should include such currently missing sections as “Regulations of Second Market of Subsoil Use Rights”, “On Small Mining Businesses”, “On Mine Decommissioning Procedures and Residual Liability of Subsoil Users.”
